Defunct paving co. faces second lawsuit

A second company has sued now-defunct R.C. & Sons Paving in Lewiston. Cote Corp., an Auburn-based crane and rigging company, said R.C. & Sons failed to pay for work Cote performed earlier this year.

In a lawsuit filed in Androscoggin County Superior Court, Cote Corp. says R.C. & Sons did not pay the company $29,990 for work it performed in Augusta, the Sun Journal reported. Cote is seeking more than $30,000 in damages, which includes interest and attorney fees. The lawsuit alleges breach of contract, among other counts. Last week, the court approved Cote's motion ordering an attachment of R.C. & Sons' assets for that amount because R.C. & Sons could sell property or otherwise conceal proceeds. The company shuttered in early June, leaving 40 workers jobless and some without their final paychecks.

Also in June, Rhode Island-based American Liquid Asphalts sued R.C. & Sons, alleging the company owes it more than $1.57 million for asphalt deliveries it received but never paid for.
