Decision upheld in Jackson Lab whistleblower case
A Maine superior court's decision of a whistleblower case won by Bar Harbor-based Jackson Laboratory last year has been upheld by the state's highest court.
The Mount Desert Islander reported that the Maine Supreme Judicial Court affirmed the Hancock Superior Court’s decision last week, denying an argument by complainant Santine Caruso’s lawyer that an error in the lower court impacted the final verdict.
Caruso was fired only a few months after starting with the Jackson Lab in 2008, saying she was terminated after raising concerns over the treatment of mice during disease research.
The supreme court agreed with Caruso's lawyer that the lower court made an error in telling its jury that Caruso’s burden of proof could only be reached if her whistleblowing had an impact on whether or not she was allowed to continue employment. However, it did not agree with her lawyer’s claim that the lower court failed to make corrections or allow a new trial after Jackson Lab’s lawyer allegedly made prejudicial remarks during the case’s closing arguments.
