Down East restaurant sues firefighters, newspaper

The owners of Cap’n Nemo’s, a Bass Harbor restaurant that burned down in December 2013, are suing members of two fire departments and, separately, a weekly newspaper.

The Bangor Daily News reported that Robert L. and Judy A. Cousins have filed a lawsuit in U.S. District Court against members of the Tremont and Southwest Harbor fire departments, alleging that the firefighters were negligent in battling the 2013 fire. An attorney for the Tremont firefighters said he is confident the evidence will show the firefighters did their job.

The Cousins are suing the Mount Desert Islander in a separate lawsuit. They allege that the newspaper committed libel against them by incorrectly stating in an article that the Cousins pumped sewage into the road. Alan L. Baker, the newspaper’s publisher, declined to comment to the BDN, saying he has not been served the lawsuit yet.
