Rockland’s Broken Egg eatery takes crack at new name amid trademark dispute

A Rockland restaurant named Broken Egg has been forced to close temporarily amid threatened legal action brought by a Destin, Fla., chain called Another Broken Egg.

In a notice sent by its law firm, Another Broken Egg claims it had trademarked the name Broken Egg, as well as Broke Egg, Break the Egg and Another Broken Egg, the Kennebec Journal reported. It has restaurants in 13 states, according to its website. 

Broken Egg owner Heather Symmt closed her place temporarily last month as she chooses a new name, which involves getting new signage and promotional materials, which she said will cost a few thousand dollars on top of business lost during the shutdown.

“I’m a small, independent shop,” she told the newspaper. “My menu is not close to their menu. My logo is not close to their logo.” She plans to reopen by May 18, the eatery’s one-year anniversary.
