Gardiner contractor sues state over unpaid invoice
A Gardiner-based contractor has sued the state for alleged nonpayment for repair work done at Camp Keyes, the Maine Army National Guard headquarters in Augusta. The state disputes the claims, saying the state never signed a contract with the company for the work.
ABJ General Contractor Inc. filed a lawsuit against the state last week in Kennebec County Superior Court, arguing it's owed nearly $500,000 for repair work to a flooded building, the Kennebec Journal reported. The company is suing for breach of contract, and also argues the state failed to obtain flood insurance. ABJ's attorney, Michael Hodgins, said the company and the Maine Department of Defense, Veterans & Emergency Management signed a contract for work on a sprinkler and fire alarm system at Camp Keyes done in 2010. In 2011, after work was finished, water from the sprinkler system flooded a building, causing damage, and ABJ performed repairs. The company said the leak resulted from a pipe loosened by someone else after installation.
According to Hodgins, the state department approved the repairs, but then refused to pay the $476,377 invoice. The state rejected the invoice because the department did not have a contract with ABJ for repairs, according to the paper.
The state did not issue a comment on the case.
