Pan Am sues Yarmouth rail newsletter for libel

Yarmouth-based trade newsletter Atlantic Northeast Rails & Ports is facing a libel lawsuit from railroad company Pan Am Systems.

Pan Am and its former chief executive, David Fink, filed the suit in September in U.S. District Court, claiming the newsletter and its editor, Chop Hardenbergh, published untrue information about the Pan Am, according to a press release. The statements that Pan Am claimed are false and defamatory relate to a New Hampshire train derailment, congestion along train corridors and at interchanges and the circumstances related to Fink's departure from the company, and some of the alleged libelous statements Pan Am cited were quotations from people interviewed by Atlantic Northeast Rails & Ports, including one that that described the rail company's service as "bad." Pan Am is seeking unspecified punitive damages.

Through his attorney, Hardenbergh on Oct. 21 asked the court to dismiss the claims. He defended his publication's contents, saying they are "perfectly appropriate journalistic statements," and arguing that Pan Am has not produced any evidence to prove the statements are false.

Pan Am Systems is a regional freight network that covers most of northern New England.
