Portland landlord files appeal over DHHS move

Portland developer Tom Toye has filed a lawsuit against the state over a decision to move the Maine Department of Health and Human Services’ offices from a downtown building he owns to a South Portland location proposed by ELC Management Inc.

The Portland Press Herald reported Toye is asking the Cumberland County Superior Court to reverse the state’s decision and force the Maine Department of Administrative and Financial Services to reconsider a proposal he made to move the department to another location on Portland’s Lancaster Street, in the city’s Bayside neighborhood.

DHHS hopes to combine its offices with the Department of Labor, a move that would require more space than its current office on Marginal Way.

In the lawsuit, filed on the last day of a 30-day appeal deadline, Toye disputes the scoring process the state used to determine the best location to move the state department. The state process led to the selection of ELC, led by Eric and Kenneth Cianchette. The ELC plan calls for construction of a new building and still needs permit approvals from the South Portland Planning Board and the Maine Department of Environmental Protection, the paper reported.
