Judge bars TD's new name in Mass.

A judge has temporarily barred TD Banknorth from using its new name, "TD Commerce Bank," in Massachusetts after a Worcester-based bank alleged trademark infringement.

Commerce Bank & Trust Co., which has 12 branches in Massachusetts, filed the trademark infringement lawsuit because it believes its customers will be confused by the TD Commerce Bank name, according to the Associated Press. A U.S. District Court judge has granted the bank a preliminary injunction, which is only temporary and prevents TD Banknorth from using its new name, pending a trial or appeal, the AP said.
