Judge denies Mallinckrodt appeal

A federal judge yesterday refused to take the side of Mallinckrodt LLC in a dispute with the Maine Department of Environmental Protection over the cleanup of the former HoltraChem chemical facility in Orrington.

St. Louis-based Mallinckrodt LLC, which owned and operated the former HoltraChem chlorine and chemical manufacturing facility from 1967 to 1982, last Friday filed an action in the federal District Court of Maine that asked the court to block the Maine DEP from forcing the company to implement what it calls "extreme and unnecessary remediation measures," according to the Bangor Daily News. The DEP in November ordered Mallinckrodt to undertake an extensive cleanup that includes the excavation of five landfills that contain 360,000 tons of mercury-contaminated soil, according to a press release from the company. The requirement could cost the company as much as $200 million, which would make it the largest environmental cleanup in the state's history, the paper reported.

The federal judge's decision to not issue a temporary restraining order against the DEP will likely force Mallinckrodt to appeal to the state Board of Environmental Protection while the larger court battle between the two parties works its way through the court, the paper reported.
