In a move that may be the first shot in a legal battle with the state, the city of Portland plans to give the Maine State Pier developer an extended lease to the property.
State and city officials both claim jurisdiction over submerged lands near the pier from low-tide to the three-mile mark, according to the Portland Press Herald. In March, state legislators voted down a proposal to extend the lease over 30 years, calling into question whether the pier developer, Olympia Cos. of Portland, would be able to secure funding for the $100 million repair and renovation.
A preliminary contract for the project, including the new lease conditions and a provision requiring Olympia or another contractor to build a deep-water berth before Olympia begins work on the pier, will be vetted by the city council's community development committee Monday. State officials said the lease extension would have to be settled between the city and the Maine Attorney General's Office before moving forward, the paper reported.
