Moratorium stalls Portland Planning Board action on Live Nation music venue

Further action on potential city approvals for Mile Marker Investments’ proposed 3,300-seat music hall on Cumberland Avenue in Portland has been postponed, possibly until March 24, 2026.

The project was up for review at a public hearing at Tuesday evening’s Portland Planning Board meeting, but after the City Council enacted a 180-day retroactive moratorium on the development of any new venue with a 2,000-seat-plus capacity August 11, the Planning Board voted to table action until its scheduled meeting after the moratorium’s end date of March 9, 2026.

Brandon Mazer, board chair, suggested the tabling. “I know the applicant won’t like it, but due to the uncertainty of the moratorium, I think it makes the most sense.”

David Farmer, managing director for crisis management and public relations at the law firm Bernstein Shur, was in attendance for Mile Marker. He said since the moratorium was not enacted as an emergency measure, it does not take effect for 30 days, and he objected to the postponement.

The motion to table passed with the caveat that if the City Council should in the interim vote to reduce the length of the moratorium, the Planning Board could reschedule a public hearing sooner than March 2026.
